End User License Agreement

Effective 28 October 2026

Licensor: Sound-O-Vision, operated by Christopher Davidson ("we", "us"). Software: Hot Spotter, the desktop application, including updates we make available to you (the "Software").

By installing or using the Software you agree to this Agreement. If you do not agree, do not install or use it.

1. License

1.1 The Software is licensed, not sold. Subject to this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software, for personal or commercial purposes.

1.2 Free use. Without a license key, you may use the Software to analyze up to 20 tracks on each computer. How tracks are counted is explained in the FAQ.

1.3 20-Track Pack. Each 20-Track Pack key adds 20 tracks on the one computer where you activate it. A pack can't be deactivated, and its tracks never move to another computer. Pack tracks don't expire, and you may buy as many packs as you like.

1.4 Unlimited. An Unlimited key removes the track limit and unlocks custom colors. It can be active on up to 2 computers at a time, which you must own or control. To move Unlimited to a different computer, choose Deactivate in the app on the old one to free its slot. If you can't (for example, the old computer was lost or broken), email us and we will free the slot.

1.5 Updates. Future updates are free for everyone, including free users.

2. Restrictions

You may not, and may not allow anyone else to:

• copy the Software except as needed to install and run it, and for backup;
• sell, rent, lease, lend, sublicense, or otherwise redistribute the Software or a license key;
• share a license key beyond the computer limits in sections 1.3 and 1.4;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent that applicable law expressly permits this despite this restriction;
• modify the Software or create derivative works of it;
• remove or alter any proprietary notice in the Software;
• get around the track limits, the custom colors lock, or the license-key checks.

3. Ownership

The Software is protected by copyright and other intellectual-property laws. We and our licensors own all right, title and interest in the Software. You keep all rights in the audio files you analyze; the Software reads them and does not modify them.

4. Third-party software

The Software includes open-source components used under their own licenses. Their notices are in the file THIRD_PARTY_NOTICES.txt inside the application bundle. Those licenses apply to those components only.

5. Privacy

The Software runs on your computer and never uploads your audio or your analysis results. What it does send over the internet, including the anonymous usage reports you can choose to turn on, is described in our privacy policy, which forms part of this Agreement.

6. Refunds

Purchases are made through Dodo Payments, our merchant of record. Both the 20-Track Pack and Unlimited come with a 14-day refund: if Hot Spotter isn't for you, email support@hotspotter.studio within 14 days of your purchase and we will refund it through Dodo Payments. A refunded key is disabled and can't be activated again. After a refund, your license to the paid features ends.

7. Term and termination

This Agreement lasts until terminated. It terminates automatically if you breach it. On termination you must stop using the Software and delete your copies. Sections 3, 8, 9 and 10 survive termination.

8. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ITS MEASUREMENTS ARE SUITABLE FOR ANY PARTICULAR DELIVERY, BROADCAST OR MASTERING SPECIFICATION. Loudness readings are informational; you remain responsible for your own releases.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE, HOWEVER CAUSED. OUR TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Nothing in this Agreement limits liability that cannot be limited by law.

10. Governing law

This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. The courts of Pennsylvania have exclusive jurisdiction, except that we may seek injunctive relief in any court. Nothing in this Agreement limits rights you have under the consumer laws of your country.

11. General

This Agreement is the entire agreement about the Software and replaces any earlier terms. If any part is unenforceable, the rest remains in effect. We may update this Agreement for future versions of the Software. The version that applies to you is the one posted on this page when the version you use came out. You may not assign this Agreement; we may assign it to a successor.
